Terms of Service

These Terms of Service ("Terms") govern your access to and use of physiq.site and the PHYSIQ platform, including all features such as the Physique Analyzer, Program Generator, Macro Calculator, Meal Planner, Phase Nutrition Planner, and Progress Tracker (collectively, the "Service"), operated by PHYSIQ ("we," "us," or "our").

By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Medical Disclaimer

The Physique Analyzer uses artificial intelligence to estimate body composition and assess physique development. These estimates are approximations based on visual data and should not be used for clinical or medical purposes. Body fat percentage estimates in particular are estimates only and may differ significantly from clinically measured values.

2. Eligibility and Account

You must be at least 13 years of age to use PHYSIQ. If you are between 13 and 17, you represent that you have parental or guardian consent to use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Service.

3. Subscription and Payments

PHYSIQ offers free and paid subscription tiers. Paid subscriptions (Base and Pro) are billed on a monthly basis through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Subscriptions automatically renew each month unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then
• We do not offer refunds for partial months of service
• We reserve the right to change pricing with 30 days notice to existing subscribers

4. Acceptable Use

You agree not to use PHYSIQ to:

• Upload photos of minors or non-consensual images of any person
• Attempt to reverse engineer, scrape, or extract data from the Service
• Use the Service for any commercial purpose without our written consent
• Submit false, misleading, or fraudulent information
• Circumvent any security measures or access controls
• Violate any applicable laws or regulations
• Harass, abuse, or harm other users

5. Intellectual Property

All content, features, and functionality of PHYSIQ — including but not limited to the design, code, AI prompts, branding, and generated outputs — are owned by PHYSIQ and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload (including photos). By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you. We do not claim ownership of your photos or data.

AI-generated programs, analyses, and meal plans are provided for your personal use only. You may not resell, redistribute, or commercially exploit any AI-generated content from PHYSIQ.

6. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

You agree to indemnify, defend, and hold harmless PHYSIQ and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

8. Dispute Resolution and Arbitration

Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including the validity, interpretation, breach, or termination thereof — shall be resolved exclusively through binding individual arbitration, not in a court of law. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

Class Action Waiver. YOU AND PHYSIQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Exception for Small Claims. Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies and remains only in small claims court.

30-Day Right to Opt Out. You may opt out of arbitration by sending written notice to privacy@physiq.site within 30 days of first accepting these Terms. Your notice must include your name, email, and a statement that you opt out of arbitration.

Governing Law. These Terms are governed by the laws of the United States, without regard to conflict of law provisions. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in the United States.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and arbitration — shall survive.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
